Terms of Service for Banana AI

Welcome to Banana AI, your advanced AI-powered image generator and editor. By accessing or using our website and services at bananaai.studio, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use our services. 1. Acceptance of Terms

By using Banana AI, you agree to comply with these Terms and all applicable laws. These Terms apply to all users of our AI image generation and editing services, whether you are using our free features or premium subscriptions.

2. Description of Services

Banana AI provides AI-powered image generation and editing services, including:

Text-to-image generation
Image-to-image transformation
Inpainting and outpainting
Style transfer and image editing
Character-consistent image modifications
Digital-only outputs. The Services deliver downloadable image files only; we do not ship or provide physical goods.

Our services are powered by Google Gemini 2.5 Flash Image technology.

3. User Accounts and Registration

To access certain features, you may need to create an account. You agree to:

Provide accurate and complete registration information
Maintain the security of your account credentials
Notify us immediately of any unauthorized use of your account
Be responsible for all activities that occur under your account

4. Acceptable Use

You agree to use Banana AI for lawful purposes only. You may not:

Generate images that violate laws, infringe copyrights, or harm others
Create content that is illegal, offensive, threatening, or inappropriate
Upload images of people without proper consent
Attempt to reverse engineer our AI models or systems
Use our services to compete with or harm Banana AI
Engage in any activity that disrupts or interferes with our services
Create adult/NSFW content, or any sexual content involving minors
Create content that uses unauthorized copyrighted or trademarked materials (e.g., logos, branded assets) without permission
Create content that impersonates real people or is otherwise deceptive (including deepfakes of public figures)

5. Content and Intellectual Property

Your Content: You retain ownership of images you upload and prompts you create. By using our services, you grant us a limited license to process your content to provide our AI services.

Generated Images: Images generated using Banana AI are owned by you and may be used for personal or commercial purposes, subject to these Terms and applicable law. You are responsible for ensuring your use does not infringe third-party rights.

Our Technology: We own the Service software, UI, and website content. The underlying AI model is Google's Gemini 2.5 Flash Image, used under applicable terms. Banana AI is an independent service and is not affiliated with or endorsed by Google.

6. Privacy and Data Protection

We handle your personal information according to our Privacy Policy. Key points:

Uploaded images are processed temporarily and not stored permanently
We do not use your images to train our AI models
Your data is protected with industry-standard security measures

7. Payment Terms

All purchases grant access to digital services/credits only; no physical goods are provided or shipped.

Free Services: We offer limited free image generations for new users.

Paid Services: Premium features require payment. By purchasing credits or subscriptions, you agree to our pricing and billing terms.

Refunds: Within 7 days of purchase we refund the unused portion only.

Refund amount = price paid − (credits used × per-credit rate).
Per-credit rate = plan/credit-pack price ÷ included credits.
After 7 days, payments are non-refundable.

8. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. We may:

Temporarily suspend services for maintenance
Modify or discontinue features with reasonable notice
Limit usage to ensure fair access for all users

9. Prohibited Content

You may not generate or attempt to generate:

Images depicting illegal activities
Non-consensual intimate imagery
Content that violates third-party rights
Deepfakes or misleading content about real people
Content that promotes violence, hatred, or discrimination

10. Disclaimer of Warranties

Banana AI is provided "as is" without warranties of any kind. We do not guarantee:

The accuracy, quality, or suitability of generated images
Uninterrupted or error-free service
That our services will meet your specific requirements

11. Limitation of Liability

Banana AI and its affiliates will not be liable for any damages arising from your use of our services, including but not limited to:

Direct, indirect, incidental, or consequential damages
Loss of data, profits, or business opportunities
Any damages exceeding the amount you paid for our services

12. Termination

We may suspend or terminate your access if you:

Violate these Terms or our policies
Use our services fraudulently or abusively
Fail to pay for premium services

You may terminate your account at any time by contacting support@bananaai.studio.

13. Third-Party Services

Our services may integrate with third-party technologies (like Google Cloud). We are not responsible for the availability, content, or practices of these third-party services.

14. Indemnification

You agree to indemnify Banana AI against any claims arising from:

Your use of our services
Your violation of these Terms
Your infringement of third-party rights
